My Perfect Story - Terms & Conditions

By placing an order with My Perfect Story Ltd. you will be deemed to have read, understood and agreed to these Terms and Conditions.

These Terms and Conditions and Privacy Policy, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by anyone else should be taken as a variation of these Terms and Conditions or as an authorised representation about the nature or quality of any goods offered for sale for us. With the exception of fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

 
1. The contract between us

1.1 Full payment for the whole of the price of the goods that you order must be received by My Perfect Story Ltd. before your order can be accepted and processed.

1.2 When you place an order to purchase a personalised product from MyperfectStory.com we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase goods which is accepted by us when we send e-mail confirmation to you that we have dispatched the goods to you (the "Dispatch Confirmation E-mail"). That acceptance will be complete at the time we send the Dispatch Confirmation E-mail to you. Any goods on the same order which we have not confirmed in a Dispatch Confirmation E-mail to have been dispatched do not form part of that contract.

1.3 A legally binding contract between us will only come into existence at the time we send the Dispatch Confirmation E-mail to you.

2. Price

2.1 The prices payable for all personalised products that you order are as set out in our website. By placing the order you accept the price on the website at the time of our order.

2.2 You will be required to pay extra for delivery and our delivery charges are also set out in our website and are correct at the time of order. Delivery charges will fall into one of 3 categories, UK, European, Worldwide.

3. Delivery of the goods to you

3.1 We reserve the right to cancel the contract between us if:
3.1.1 we have insufficient stock to deliver the goods you have ordered;
3.1.2 we do not deliver to your area;
3.1.3 one or more of the goods you ordered was listed at an incorrect price due to a typographical error in the pricing information;
3.1.4 we deem that the photograph submitted to us is in breach of copyright; or
3.1.5 we deem that the photograph submitted to us does not meet the quality criteria set out in our website.

3.2 If we do cancel your contract we will notify you by e-mail and we will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible but in any event within 20 working days of your order. We will not be obliged to offer you any additional compensation for disappointment suffered.

4. Cancellation by you & refund policy

4.1 Your contract cannot be cancelled once order confirmation and payment confirmation emails have been sent to you because your My Perfect Story Ltd. product is personalised and once the confirmations are sent production will begin and the product will be custom made for you.

4.2 However once you have received your product, if you are not happy with the quality, if you advise us of this and that you want a refund with your reasons within 14 days My Perfect Story Ltd. will refund you for the cost of your book (please note postage and packaging costs will not be refunded). You will need to advise us via the website contact us section, via email to info@myperfectstory.com or by writing to us at My Perfect Story Ltd., PO Box 1904, Croydon, CR90 9BF.

4.3 The refund will be provided via the same method you made the original payment to us with, once the personalised product being refunded is received back to My Perfect Story Ltd., posted to the address My Perfect Story Ltd., PO Box 1904, Croydon, CR90 9BF. Please use your original order reference with any co-rospondance to ensure speedy processing by allowing us to quickly find all associated details.

4.4 Any associated postage cost for your return postage will be responsibility of the sender.

4.5 In all circumstances a refunds will be given at the sole discretion of the My Perfect Story management team

4.6 The refund will not effect your statutory rights.

4.7 Please also refer to section 6 of These Terms and Conditions.

5. Cancellation by us

5.1 We will deliver the personalised books ordered by you to the address you give us for delivery at the time you make your order.

5.2 Delivery will be made as soon as possible after your order has been accepted and processed but in any event within 21 days of your order.

5.3 You will become the owner of the goods you have ordered when they have been delivered to you. Once the goods have been delivered to you they will be held at your own risk and we will not be liable for their loss, damage or destruction.

5.4 Please ensure you pay especial attention to lead times around “special event” (i.e. Christmas or Birthdays etc) books, if delivery is required before the special event. The website will process orders and the maximum 21 day leadtime will apply in all cases (as per conditon 5.2), even if that 21 leadtime will mean the product will be delivered after the “special event”. My Perfect Story cannot be held liable should a product arrive after the “special event” if the product is delivered within 21 days as per condition 5.2.

6. Limitations of liability & disclaimer

6.1 In the unlikely event that the products delivered to you are damaged, defective or of the incorrect quantity we shall only have liability to correct this if you notify My Perfect Story of the problem in writing within 14 days of delivery of the goods in question. Written notification must be made via contact details in clause 10 below.

6.2 If you have not received your personalised products within 21 days from order confirmation My Perfect Story Ltd. will have no liability unless you have notified us within 40 days of the order being placed via contact details in clause 10 below.

6.3 If you notify a problem to us under this condition, our only obligation will be, at your option:
6.3.1 to make good any shortage or non-delivery;
6.3.2 to replace or repair any personalised product that are damaged or defective; or
6.3.3 to refund the amount paid by you for the personalised product in question in whatever way we choose.

6.4 To the fullest extent permitted by law and save as provided above in paragraph 6.3, My Perfect Story Ltd. shall not be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of My Perfect Story Ltd. or any of our members, agents, directors, employees or otherwise) for any indirect, special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of our website, the supply of the goods or their use or resale by you.

6.5 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our website. Certain national laws may prohibit the importation or exportation of certain of our goods to you. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

6.6 While My Perfect Story Ltd. uses reasonable endeavors to ensure that the information on our website is accurate and up to date, we do not give any gurantee as to its accuracy or completeness and MyPerfectStory.com will not be responsible for any errors or omissions or for the results arising from the use of such information.

6.7 While My Perfect Story Ltd. takes all reasonable steps to ensure a fast and reliable service, we do not guarantee that your use of our website will be interruption or error free and we will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

6.8 Further, My Perfect Story Ltd. will not be responsible nor liable for your use of any other websites which you may access via links within our website. Their inclusion in our website does not constitute an endorsement by or affiliation with MyPerfectStory Ltd. usless this is explicitly expressed on our website.

6.9 The entire liability of My Perfect Story Ltd under or in connection with any contract for any goods to which these Terms and Conditions apply shall not exceed the price of the goods, except if expressly provided in these Terms and Conditions.

6.10 My Perfect Story Ltd. shall not be liable to you or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of our obligations in relation to the goods ordered by you if the delay or failure was due to any cause beyond our reasonable control, including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident. In all such cases, on a best endeavors basis, My Perfect Story will email details of any such disturbance and when remedy, and eventual delivery of your product is expected.

6.11 My Perfect Story Ltd. may assign or transfer any of our rights or sub contract any of our obligations under these Terms and Conditions to any third party. You may not assign or transfer any of your rights or sub contract any of your obligations under these Terms and Conditions.

6.12 No person who is not a party to these Terms and Conditions shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. Nothing in these Terms and Conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.

7. Copyright

The copyright in the goods is and shall remain the property of My Perfect Story Ltd. By sending us a digital photograph you are warranting to us that you own the copyright in that digital photograph. You are also authorising us to manipulate and use that image in order to produce the personalised product ordered by you.

8. Legal Jurisdiction & Dispute Resolution

8.1 English law shall apply to these Terms and Conditions, notwithstanding the jurisdiction where you are based. You irrevocably agree that the courts of England shall have non-exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms and Conditions and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts. The place of performance of the contract shall be England.

8.2 We make no claim or guarantee that MyPerfectStory.com or information provided on it currently complies with laws other than those of England.

9. General

9.1 Any formal legal notices should be sent to us at the address in clause 11 below by email and confirmed by post.

9.2 Failure by us to enforce a right does not result in waiver of such right.

9.3 You may print and keep a copy of these Terms and Conditions. They are the legal agreement between us and can only be modified with our consent. We reserve the right to amend the Terms and Conditions at any time by posting a variation on our website.

9.4 The content of the book, both illustrated and written, is subject to change without notification.
